Compliance Requirements and Frequency

  • All air conditioning systems with an effective combined rated output of more than 12kW must be regularly inspected by an energy assessor.
  • The first inspection must take place within five years of the system being put into service.
  • Further inspections are required at least every 5 years.
  • Any system which undergoes a change of ownership (i.e. where a building may have been sold) and no inspection report was given to the new owner, a new inspection must be completed within three months.

Scope of the Inspection

A TM44 inspection typically includes:

  • Examining documentation that explains how the system works and how it has been maintained.

  • Reviewing the refrigeration and air-moving equipment that make up the air conditioning system.

  • Assessing the controls used to manage operation and efficiency.

  • Checking F-Gas compliance.

  • Estimating whether the system is suitably sized for the cooling loads in the treated spaces.

  • Providing recommendations to improve performance and efficiency.

Types of Air Conditioning Inspection Required

There are two levels of Air Conditioning Assessors. Level 3 and level 4.

Level 3: Covers simpler systems, including single split, multi-split, and VRF/VRV systems.

Level 4: Covers complex systems, including chillers and mechanical ventilation systems.

Who is responsible for TM44 Compliance

The duty to comply rests with the party that has control over the operation and maintenance of the air conditioning system. This may be the building owner, the landlord, or the tenant, depending on the terms of the lease or management agreement.

The responsible party must ensure that a valid TM44 inspection is carried out at the required intervals to maintain legal compliance.

In some circumstances a building may require several inspections. The landlord may have control over the Chiller and AHUs and tenants have their own split systems.

If you do not hold a valid TM44 you could be issued with fixed penalty notices of £300 per offence. For example if your company has 10 buildings that are all non-compliant, your fine could total to £3,000. Additionally, the fines are repeatable until you can produce a valid TM44.
